Remember that dial up tone from the 90’s? I’m glad we don’t have to wait for the internet to connect anymore, thanks to technology changes. I know, random, but there’s a point to this. THINGS CHANGE. And when things change that are personal to you, chances are, you’ll need to change the original agreements or court orders. There’s magic legal language that I just can’t escape: there has to be a substantial change in circumstances that was unanticipated, is material and permanent.
So what does a modification case look like? Well, honestly, it looks a lot like your initial case. Unless there’s an agreement to modify, you’re basically starting the process over again for just that limited issue that you’re trying to modify – just this round is MUCH more difficult because, as the person requesting the change, you have to prove to the court that magic legal language that I just shared with you: there has to be a substantial change in circumstances that was unanticipated, is material and permanent.
